These terms apply to your use of highwaterbonsai.com, purchases from our online store and nursery, and participation in our workshops. High Water Bonsai LLC (“High Water Bonsai,” “we,” “us”) is a Texas limited liability company based in San Antonio. By using the site or buying from us, you agree to these terms. If you don’t agree, please don’t use the site.

Products and Descriptions

Bonsai are living plants, and no two are alike. Here’s what our photos show:

  • Specimen, one-of-a-kind, or artist-level trees. When a listing is labeled this way, the photos show the actual tree you’ll receive.
  • Pre-bonsai and nursery stock. For these, photos show a representative example. Your tree will be similar in size, species, and quality, but not identical.

Trees keep growing after we photograph them. Foliage, color, and leaf count can change with the season and between listing and shipping.

Handmade pots vary in glaze, color, and finish. Screen colors also vary, so a pot may look slightly different in person.

We work hard to keep descriptions accurate. If we make a mistake in a listing, we’ll contact you before shipping and give you the option to cancel.

Prices, Payment, and Order Acceptance

  • Prices and taxes. All prices are in US dollars. Texas sales tax is added where it applies.
  • Payment. We process payments through Square. We don’t store your card information.
  • When an order is final. Placing an order is an offer to buy. The order isn’t accepted until it ships or you pick it up.
  • Our right to cancel. We may cancel an order for several reasons, including an item that’s no longer available, a pricing or listing error, or suspected fraud. If we cancel, you’ll get a full refund.
  • Pricing errors. If an item was listed at the wrong price, we’ll let you know the correct price before shipping. You can then choose to buy at that price or cancel.

Shipping

We ship only within the United States. Some states restrict the import of certain plants, soils, or pests under agricultural regulations. If we can’t legally ship an item to your state, we’ll let you know and refund that item.

We may hold shipments of live plants during extreme heat or cold to protect the trees. Our Return Policy explains how weather holds affect our arrival guarantee.

Once your package is delivered to the address you provided, you’re responsible for it. Make sure your shipping address is correct, and plan to bring live plants inside or into shade promptly after delivery.

Returns and Refunds

Returns, refunds, and damage claims are governed by our Return Policy. It’s part of these terms.

Plant Care Advice

We share care guides, workshop instruction, and advice in person and online because we want your trees to thrive. That advice is general guidance. How a tree does in your care depends on your climate, setup, and attention, and we can’t guarantee results.

Workshops and Classes

  • Cancellations and transfers. Workshop cancellations, transfers, and credits follow our Return Policy.
  • Our right to reschedule. We may reschedule a workshop for weather, low enrollment, or other reasons. If we cancel and you can’t attend the new date, we’ll refund your fee.
  • Safety. Bonsai work involves sharp tools, wire, and soil. You take part at your own risk and agree to follow the instructor’s safety guidance.
  • Minors. Participants under 18 must have a parent or guardian’s permission. Participants under [14] must be accompanied by a parent or guardian for the entire workshop.
  • Photos. We may take photos during workshops for our website and social media. If you’d prefer not to appear in them, just tell us.
  • Asking someone to leave. We may ask anyone who is disruptive or unsafe to leave. In that case, no refund is issued.

Visiting the Nursery

The nursery is a working growing space. When you visit:

  • Stay on paths.
  • Supervise children at all times.
  • Ask before handling trees, especially display trees.
  • Please leave pets at home unless we’ve arranged otherwise.

Our display collection is not for sale unless it’s marked otherwise.

Accounts

If you create an account, keep your login information secure. You’re responsible for activity under your account. We may suspend accounts that are used for fraud or abuse.

Our Content

Text, photos, logos, care guides, and other content on this site belong to High Water Bonsai unless we say otherwise. You’re welcome to share links and to print care guides for personal use. Don’t copy, sell, or republish our content without written permission.

If you post comments, you’re responsible for what you post. We may remove anything spammy, abusive, or off-topic.

Disclaimers and Limits of Liability

We stand behind the guarantees in our Return Policy. Beyond those guarantees, the site and our products are provided as-is. To the fullest extent Texas law allows:

  • We aren’t liable for indirect or consequential damages.
  • Our total liability for any claim related to a purchase is limited to the amount you paid for that item.

Nothing in these terms limits rights you have under law that can’t be waived.

Governing Law

These terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts located in Bexar County, Texas.

Changes

We may update these terms from time to time. The version posted here, with its “last updated” date, is the one in effect.
